Terms of Service

You must be at least 18 years old to use the Service. If you are creating a clinic account, you confirm that you are authorized to enter into these Terms on behalf of your business and that the information you provide is accurate.

Skinalyzer provides clinics with: (a) a hosted scanner link where visitors can submit a selfie and contact details, (b) an AI-powered skin analysis returned to the visitor as a personalized report, and (c) a dashboard where clinics can view leads, results, and account settings. Features may evolve over time.

The skin analyses, scores, and recommendations produced by the Service are provided for informational and educational purposes only. They are not medical advice, diagnosis, or treatment, and they are not a substitute for consultation with a qualified healthcare or licensed aesthetic professional. Do not rely on the Service for medical decisions. Always consult a qualified professional regarding any skin condition or treatment.

To use the dashboard you must register at /register. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at admin@skinalyzer.io if you suspect unauthorized use of your account.

Visitors submit photos and contact details through your scanner link. If you operate a clinic account, you represent and warrant that:

• You have a lawful basis to receive, store, and contact the visitors whose information is routed through your scanner.
• You will provide your own privacy notice to visitors and comply with applicable laws, including marketing, telecommunications, and health-information laws in your jurisdiction.
• You will not use the Service to send unsolicited messages or to make claims that the analysis constitutes medical advice or treatment.

Visitors retain ownership of their photos and contact details and grant Skinalyzer the rights described in our Privacy Policy so that we can operate the Service.

You agree not to:

• Use the Service to violate any law, regulation, or third-party right.
• Submit photos that you do not have the right to upload, or photos of minors.
• Reverse-engineer, scrape, copy, or attempt to extract the underlying models, prompts, or source code of the Service.
• Use the Service to build a competing product or to train a machine-learning model.
• Interfere with or disrupt the Service, our infrastructure, or our third-party providers.
• Misrepresent your identity, your clinic, or your affiliation with Skinalyzer.

The Free plan is offered at no charge and includes the features described on skinalyzer.io. Paid plans (such as Pro) are billed in advance on a recurring basis at the rate displayed at checkout. Unless otherwise stated, subscriptions renew automatically until cancelled. You can cancel at any time, and cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable.

We may change pricing or plan features with reasonable notice. Changes will not apply retroactively to the current paid billing period.

Skinalyzer and its content (excluding visitor and clinic content) are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All other rights are reserved.

You retain ownership of content you submit to the Service. By submitting content you grant us a worldwide, royalty-free license to host, store, process, transmit, and display that content solely as necessary to operate and improve the Service.

If you send us feedback or suggestions, we may use them without restriction or obligation to you.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have breached these Terms, used the Service in a way that creates risk for us or others, or if required by law. You may stop using the Service or delete your account at any time by contacting admin@skinalyzer.io. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, and limitations of liability.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE, OR THAT THE SKIN ANALYSIS WILL BE CORRECT OR SUITABLE FOR ANY PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKINALYZER AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) OR (B) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless Skinalyzer and its officers, directors, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your content, (c) your breach of these Terms, or (d) your violation of any third-party right or applicable law.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute that is not subject to binding arbitration or required by law to be heard elsewhere. You and Skinalyzer each waive any right to a jury trial.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, take reasonable steps to notify clinic account holders. Continued use of the Service after a change constitutes acceptance of the revised Terms.
